Supreme Court Decision on Article 370 on THIS Date

New Delhi, December 9, 2023 – All eyes are on the Supreme Court as it gets ready to announce its decision on the Article 370 abrogation case this Monday, December 11. The case questions the government’s move in 2019 to end the special status of Jammu and Kashmir granted by Article 370.

The Chief Justice of India, DY Chandrachud, along with Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant, will share their verdict after spending 16 days thinking about it and keeping the decision under wraps since September 5.

The legal team representing the petitioners includes well-known lawyers like Kapil Sibal, Gopal Subramanium, Rajeev Dhavan, Dushyant Dave, and Gopal Sankaranarayanan.

They argue that the government, using its majority in Parliament, used executive orders to turn the state into the Union Territories of Jammu and Kashmir and Ladakh. The petitioners say this is not just a change in procedure but an attack on the way power is shared between states and the central government.

The case isn’t just about legal technicalities; it’s sparking discussions on how much power states should have compared to the central government. The decision will not only impact the legal landscape but also have political, social, and historical implications.
