Cheque Bounce Case: Kashmir Court Sends Man to Jail for 2 Years, Fines 16 Lakh

Kashmir – In a recent ruling, the court of Special Magistrate Baramulla, under Sub-judge Iqbal Ahmad Akhooon, has sentenced Ameer Ahmad Khan from Boniyar, Baramulla, to two years of imprisonment and ordered him to pay a substantial fine of Rs 16 lakh as compensation to the complainant.

Ameer Ahmad Khan was found guilty of violating section 138 of the Negotiable Instrument Act, leading to this verdict. According to the court’s order, copies of which have been obtained by ProKashmiri (PK).

It was established that Khan’s cheques, issued to the complainant Abdul Lateef Khan, were returned unpaid by the bank due to insufficient funds in Khan’s account.

During the trial, the complainant successfully demonstrated that Khan was legally obligated to pay the debt in question, and he had issued the disputed cheques, which subsequently bounced due to a lack of funds in Khan’s account.

In addition to the two-year imprisonment, Ameer Ahmad Khan has been directed to pay Rs 16 lakh to Abdul Lateef Khan as compensation.
